TERMS & CONDITIONS

  1. Peter Benson Photography are unable to accept bookings from persons under 18 years old, unless accompanied by a fully paying adult.

  2. For single day walk and workshops, payment must be made full five days before the commencement of the walk and workshop.

  3. For residential walks and workshops, a deposit of 25% of the fee will be required at the time of booking and the balance being payable twenty-one days before the workshop commences. If a residential walk and workshop is booked less than twenty-one days in advance of the workshop date full payment will be payable at the time of booking.

  4. If full payment is not received by the specified date, Peter Benson Photography reserve the right to treat the booking as cancelled and re-sell the place, the deposit is not refundable.

  5. Single day walk and workshops and residential walks and workshops hereafter are called workshop or workshops.

  6. An individual who attends a workshop whether they paid the fee themselves or the fee was paid on their behalf and the payee shall be hereafter are called the client.

  7. All workshop payments secure the booking for the specific date of that workshop.

  8. Should a client cancel their place on a residential workshop less than twenty-one days before the workshop date, the client will be liable for the full cost. If the client cancels their place on a workshop more than twenty-one days prior to the workshop the deposit will be retained.

  9. In the case of a single day workshop if a client cancels less than three days before the workshop date the client will be liable for the full cost. The workshop place may be transferred to a later available date.

  10. On workshops that include overnight accommodation, rooms are booked and allocated on a single occupancy basis and unless stated elsewhere accommodation does not include meals and drinks.

  11. Peter Benson Photography reserves the right to alter or cancel any workshop due to under-booking, Covid or force majeure (defined as unusual and unforeseeable circumstances beyond our control, such as a declaration of war, riots, terrorist activity, civil strife, industrial disputes a disease epidemic, or a hurricane, earthquake, or other natural disaster events that fall under the legal term, “act of God”.  In the event of cancellation by Peter Benson Photography we will offer you either a place on another workshop or a credit of the amount paid to use on a future workshop. If the workshop is a lower fee than the credited amount then a refund of the difference will be made. If the workshop is a higher fee than the credited amount you will be required to pay the difference.

  12. Where a workshop has been cancelled, we will not provide refunds for any accommodation booked by a client or refund the cost of any travel arrangements (e.g., flights, trains, taxis) made by the client or any other expenses incurred due to the cancellation. For this, we recommend that clients obtain a holiday insurance policy to cover themselves against injury, cancellation and their possessions which include their photography equipment.

  13. The client is expected to follow any instructions that the workshop leader might give especially where those instructions are for the health and safety of yourself and others.

  14. A number of the areas that are used  on workshops to take photographs are private property and the public are given access to that property, participants are expected to follow the property managers / owners instructions whether given verbally or written. 

  15. The client as a participant of a workshop, ultimately takes responsibility for their own safety. In the event that you should find yourself in a situation where you feel unsafe let the workshop leader know as soon as possible and they will review the situation with you and act accordingly so that you feel safe.

  16. Where it is deemed that a client‘s behaviour is putting either themselves, others wellbeing at risk, or are causing damage to property that client’s involvement with the workshop will end. In these circumstances no refund will be forthcoming or re-booking will be given or accepted.

  17. All clients participate at their own risk and Peter Benson Photography accepts no responsibility to the Client for any loss or damage arising from the negligent act or omission of any third-party supplier or service provider or their employees or agents. In addition, Peter Benson Photography cannot be held responsible for any inadequate or unsatisfactory service supplied by a third party.

  18. The outline itinerary and workshop description must be taken as an indication of what may take place on the workshop, and not as a contractual obligation, given that outside influences, for example, weather, local restrictions and the capability of participants can vary an itinerary.

  19. The client must communicate any perceived failure in the performance of this contract on the spot to the workshop leader thus giving the workshop leader the opportunity to achieve a satisfactory solution. Should this not be possible, you should make your complaint known to us in writing within 28 days of the completion of the workshop.

  20. In the event that one or more of these clauses contained within are deemed to be invalid by a court of law all other remaining clauses shall still be in force.

  21. Any variation to these Terms and Conditions does not set any precedent for any variation of these terms and conditions in the future.

  22. By making a booking you are agreeing to accept these Terms and Conditions. A client making a booking with Peter Benson Photography on behalf of other individuals does so that all clients are bound by Peter Benson Photography Booking Terms and Conditions.
